These Terms and Conditions (“Terms”) govern use of the Apostille Assist website and any service that we accept. Please read them before sending documents or making a payment.

1. Business Identity

“Apostille Assist,” “we,” “us,” and “our” refer to that operator. “Customer,” “you,” and “your” refer to the person or organisation using the website or requesting a service.

2. Acceptance Without a Checkbox

These Terms are made available through the website and may also be linked in a quotation, invoice, form, message, or payment request.

By accessing or continuing to use the website, you agree to the provisions that govern website use, to the extent permitted by law. Merely visiting the website does not place an order or require payment.

You affirmatively request a service when you submit an enquiry or form, call or message us with instructions, send documents, approve a quotation, or make a payment. A separate Terms checkbox is not required. A service agreement is formed only when we accept the request as described in Section 4.

If you do not accept these Terms, do not use the website or instruct us to begin a service.

3. Nature of the Service

Apostille Assist is an independent private document-assistance and coordination service. We are not a government body or official government website, and we do not issue apostilles, attestations, legalisations, visas, or government approvals. Our independent status and the limits of our role are explained in the Service Disclaimer, which forms part of these Terms.

Services may include, as stated in a written quotation or confirmation:

  • preliminary review of documents and general requirement guidance;
  • preparation assistance for forms or supporting paperwork;
  • coordination of notarisation, translation, verification, apostille, attestation, legalisation, collection, or delivery;
  • permitted submission to and collection from an authority or designated channel; and
  • courier coordination and status communication.

The exact written scope accepted for a customer controls. A service not expressly included is outside the agreement.

4. Formation and Scope of a Service Agreement

An enquiry is not automatically accepted. A service agreement is formed when:

  1. you provide enough information for us to identify the requested service;
  2. we send a written quotation, invoice, or confirmation describing the scope and price;
  3. you approve it through a clear action, such as written confirmation, document submission, or the requested payment; and
  4. we accept the instruction or begin the confirmed work.

If a quotation contains special conditions, those conditions apply to that service. If they conflict with these Terms, the more specific written condition controls for that issue. Verbal estimates are not binding until confirmed in writing.

We may conduct a preliminary review before acceptance. That review is not official verification and does not guarantee that an authority will accept the document.

5. Quotations, Fees, and Payment

Our quotation or invoice will identify the known price and should distinguish, where applicable:

  • our professional assistance or coordination fee;
  • government, embassy, consular, notarial, verification, or other official charges;
  • translation, courier, payment-provider, or other third-party charges; and
  • applicable taxes.

Our professional fee is a private service charge and is not a mandatory government fee. A customer may use an available official direct channel instead of our service.

Prices apply only to the document, destination, timeframe, and facts stated in the quotation. If an authority or customer later changes the requirement, we will disclose any material extra work or charge and obtain approval before proceeding. If approval is not given, we may pause or close the affected service and apply the Refund and Cancellation Policy.

Payment is due in the amount and at the stage shown in the quotation or invoice. We may wait for cleared funds before starting or paying a third party. The customer is responsible for lawful bank, card, foreign-exchange, or transfer charges imposed on the customer’s side. We will issue or make available an appropriate payment record.

6. Customer Eligibility and Authority

You must be at least 18 years old and legally capable of entering into the agreement. If you act for another person, a child, a company, or another organisation, you confirm that you have valid authority to give instructions, submit documents, approve processing, and receive communications or deliveries on their behalf.

We may request identity, authority, ownership, or consent evidence. We may suspend work if satisfactory evidence is not provided.

7. Customer Responsibilities

The customer must:

  • provide genuine, lawful, accurate, complete, and legible documents and information;
  • disclose the destination country, intended use, deadline, and any instructions from the receiving organisation;
  • review names, dates, spellings, translations, addresses, forms, and drafts when asked;
  • respond promptly to requests for information, approval, originals, or additional payment;
  • maintain lawful copies of important documents and provide secure, correct collection or delivery details; and
  • tell us promptly about any change that may affect the request.

We may rely on information supplied by the customer unless an error is apparent. The customer is responsible for consequences caused by forged, altered, misleading, incomplete, or unlawfully obtained material, or by withholding a relevant fact.

Providing false documents or asking us to mislead an authority is prohibited and may be reported where required by law.

8. Processing Times and Availability

Any processing or delivery time is an estimate, calculated from the point at which we have accepted the service and received all required documents, information, approvals, and cleared funds.

Our contact channels are available 24 hours for enquiries and messages. This does not promise an immediate response or 24-hour official processing. Government authorities, embassies, consulates, notaries, translators, couriers, banks, and other third parties operate according to their own working days, holidays, cut-off times, and service levels.

Do not book non-refundable travel, resign from employment, commit to admission, or incur another major obligation solely on the basis of an estimated completion date.

9. Authority Decisions and Changed Requirements

The competent authority or receiving organisation has the final decision. We do not guarantee approval, completion by a particular date, or acceptance for the customer’s intended purpose.

An authority may change a rule, require another document, conduct verification, return an application, reject it, or impose an additional official fee. We will communicate a material development when known and request approval for any resulting change to our scope or price.

10. Documents, Translation, and Delivery

By giving us original documents or instructing delivery, you authorise the handling reasonably required for the accepted service. We will use reasonable care and choose appropriate handling methods, but documents may need to pass through authorities, designated providers, translators, notaries, couriers, or other third parties.

Third-party services are subject to their own operational terms. We will reasonably assist with a trace or claim for loss or damage and pass on any recovery received for the customer, after permitted costs, but we do not control a third party’s investigation or compensation limit. Nothing in this paragraph excuses loss or damage caused by our own failure to use reasonable care.

The customer must provide a complete delivery address, available recipient, correct telephone number, and any special delivery instruction before dispatch. Re-dispatch caused by incorrect or unavailable delivery details may require an additional charge disclosed to the customer.

Where translation is included, the customer must review any draft or spelling confirmation requested. A receiving authority may require a particular translator, format, certification, or fresh translation; that decision remains outside our control.

11. Communications

We may communicate through the contact details and channels the customer provides, including telephone, WhatsApp, email, SMS, or courier. The customer must keep those details current and check messages, including spam folders.

Instructions received from a provided contact method may be treated as authorised unless we have reason to doubt them. We may request additional verification before acting on a sensitive instruction, such as changing the recipient or bank details.

Service and transaction messages may be sent while a request is active. Marketing communications are governed separately by the Privacy Policy.

12. Cancellation and Refunds

Cancellation rights, non-recoverable costs, stage-based deductions, refund calculations, payment reversals, and refund timing are governed only by our Refund and Cancellation Policy. That policy forms part of the service agreement. Nothing in it limits a mandatory remedy available under applicable consumer law.

13. Privacy

Our collection and handling of personal data and documents are governed by the Privacy Policy. By submitting another person’s data, you confirm the authority described in Section 6 and agree to provide any notice or obtain any permission required by law.

14. Prohibited Use

You must not use the website or our services to:

  • submit or facilitate a forged, altered, stolen, unlawful, or misleading document;
  • impersonate another person or act without authority;
  • evade a lawful process, sanction, restriction, or authority requirement;
  • introduce malware, scrape the website unlawfully, interfere with security, or gain unauthorised access;
  • misuse our name, content, contact details, or quotation; or
  • threaten, abuse, or unlawfully discriminate against staff, contractors, providers, or other users.

15. Refusal, Suspension, or Termination

We may refuse, pause, or terminate a service for a reasonable cause, including suspected fraud or illegality, safety or security risk, missing authority, non-payment, abusive conduct, an unmanageable conflict, repeated failure to provide required information, or a request we cannot lawfully or practically perform.

Where practical, we will explain the reason and give an opportunity to correct a curable issue. Any amount due or refundable on termination will be calculated under the Refund and Cancellation Policy and applicable law.

16. Website Content and Third-Party Links

Unless otherwise stated, website text, layout, graphics, branding, and original materials belong to Apostille Assist or are used with permission. You may view or print a reasonable copy for personal service-related use. You may not republish, sell, impersonate, or commercially exploit our content without written permission, except as allowed by law.

Third-party links and official names are provided for identification or convenience. We do not control an external website and are not responsible for its availability, content, security, or separate terms.

17. Service Standard and Responsibility

We will perform an accepted service with reasonable skill and care. If we make a material service error, we will consider an appropriate remedy, which may include correction, re-performance, or a proportionate refund, subject to the circumstances and applicable law.

We are not responsible for a loss caused by an authority’s decision, a lawful change in requirements, customer delay or inaccuracy, or a third party outside our reasonable control. To the extent permitted by law, neither party is responsible for remote or indirect loss that was not reasonably foreseeable when the service was accepted.

Nothing in these Terms excludes liability for fraud, wilful misconduct, gross negligence, or any responsibility or consumer remedy that cannot lawfully be excluded or limited. The customer must take reasonable steps to reduce avoidable loss and notify us promptly of a material problem.

18. Events Beyond Reasonable Control

Neither party is responsible for delay or failure caused by an event beyond reasonable control, such as authority closure, system outage, strike, civil disturbance, disaster, epidemic, transport disruption, courier embargo, change in law, or failure of a government portal. The affected obligation will be paused for the duration of the event. We will take reasonable steps to reduce disruption and will discuss a practical continuation, cancellation, or refund of unused and recoverable amounts where performance becomes impracticable.

19. Complaints

Please send a service complaint with the order or invoice reference and a clear description of the issue through the official email, phone/WhatsApp number, or postal address listed in Section 1.

We will acknowledge and investigate the complaint within a reasonable period. Privacy grievances should be made under the Privacy Policy. Refund requests should be made under the Refund and Cancellation Policy.

20. Governing Law and Disputes

These Terms are governed by the laws of India. Subject to any mandatory consumer forum or other jurisdiction that cannot lawfully be excluded, courts and tribunals with jurisdiction in CHANDIGARH, INDIA will have jurisdiction.

Before starting formal proceedings, each party should make a reasonable good-faith attempt to resolve the issue through the complaint process. This does not prevent either party from seeking urgent relief or using a statutory consumer or regulatory remedy.

21. Changes and General Provisions

We may update these Terms prospectively by posting a revised version with a new date. The Terms accepted for an existing paid service will continue to apply to that service unless a change is required by law or both parties agree otherwise.

If a provision is held invalid or unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver. We may use suitable employees, contractors, and service partners to perform the accepted work while remaining responsible for obligations that the law places on us.

These Terms, the accepted quotation or confirmation, the Service Disclaimer, the Privacy Policy, and the Refund and Cancellation Policy form the agreement for the relevant subject matter and replace earlier statements about that same matter.
